With a field house in an uproar and the State legislatures in session, you can expect a lot of changes over the next 2 quarters. The Nationwide Mortgage Licensing System debuted last month and has already begun to move strongly in 7 different countries. FHA would have to change radically with the U.S. Congress has threatened to bring a new law. Many states probably do before the accounts to the lender requires the borrower's ability to repay their loans control. This meansdeclared income is probably a program of the past. Member States will continue their dramatic conditions in a sector which is already regulated. It means more state-controlled loan officer and branch license required.

Here's an update on mortgage Licensing points to note:

Colorado clarifies Trigger for licenses

On January 7 independent Colorado Division of Real Estate can solve the "… uncertainty in the market on what is required to be licensed." Guidance states that "persons who directly supervise those who negotiate, originate, or offer or attempt to negotiate or to reach the borrower, and for a commission or other thing of value, a container> Bond should be conducted and financed by a mortgage lender "must be individually authorized as a mortgage broker. The division explained that the people that only administrative tasks that are required to be individually authorized as a mortgage broker. Position Statement provides administrative duties include (i) the receipt, collection, dissemination and analysis of information in general for the treatment or the acquisition of a bond, and (ii)communication with the consumer that the information necessary for processing or acquisition of a loan to the extent that such communication does not contain an offer or negotiating loan rates or terms, or advice to consumers on price or terms.

Nebraska Licensing Branch

Dakota was the first to move to the Nationwide Mortgage Licensing System (NMLS), with a transition period of 28 February 2008. Included in the limit of time is a new branchlicensing requirements for the state. Be sure to add all the branches you want to be able to do business in Alaska before the deadline.

New York, Loan Originator Rules

On 19 December, a et seq.) New York State Banking Department (NYSBD) issued rules implementing the new state statute guides originator license (NY CLS Bank § § 599 – that thing took effect January 1, 2008. According to responsible for the rules have not previously workedNew York, will be required to seek approval before 1 April 2008, but producers of or in connection with a New York bank or broker in use before 2008 are not required to submit an application to 1 July 2008. The accreditation process will use the Nationwide Mortgage Licensing System (NMLS), which will be operational January 2, 2008. Candidates must also take the fingerprints, credit history and proof of their financial history and criminalinformation.

Nationwide Mortgage Licensing System (NMLS) Update

With the release of the new Nationwide Mortgage Licensing System January 2, 2008, there is much speculation that the system would increase to its goal of bringing together licensing process that permits easier for licensees and maintenance of legislators and regulators to help keep bad company. Still in transition, we have not seen or the last goalis ready, but we can see what system and what is easy to use. So far I have found a way to assemble the whole process dramatically. Most of the time of application in different states was before the process of finalizing the same information over and over for each state. The system is easy enough to use for multiple user access to corporate, branch and loan originator information to fit any State, at the same time.Another thing that has worked well for the system is the call center. The people who work there are very helpful, answering phones quickly, and doing their best to answer all questions as completely as possible. Personally, I had a run in the country where they were not very cooperative, like most states, but the system forced them to follow protocol and go as he would let go once. Absolutely, I see the system and bring a much needed change ofserious problem with the current licensing guides are treated in many countries.

FHA Update

FHA is one of the most interesting topics to talk about months. Parliament approved a law that will increase FHA loan limits to as high as 125% of the average home, which would be about $ 775,000 in California. House bill also has provisions for a security, rather than audited financial when applying for renewal of an FHA loan correspondent (Mini-Eagle)Approved. Senate bill seeks only to increase the maximum FHA loan limit for Fannie Mae, which right now is $ 417,000 consistently. Senate bill contains a provision of a surety bond. Currently, the Senate and House committees in the direction of a compromise on these two bills. To be added to the tension that has been signed Assembly, Senate and administration of the economic stimulus agreement last week which called for the FHA bill is advancing rapidly, and few othersimportant changes specifically help the housing market in distress. This means that the House of Representatives and the Senate the bill is likely to experience a couple of weeks, if not before. The pressure is very great moment, as can be driven in a recession. Expect to see some major changes in the FHA in the very near future.
